Terms of use ZimaOffice® Business

1. Subscription:
It is assumed that the customer is of legal age
to subscribe at ZimaOffice Inc.
Subscriptions is paid quarterly in advance, and
can be terminated at any time before the expiry
of a prepaid subscription period. Subscriptions
run from the contract and 3 months, and then
automatically renewed every 3 months for a new
subscription period.
Violation of the subscription terms will be
considered as abuse of ZimaOffice Inc. This can
always lead to the closure and termination of a
subscription. ZimaOffice Inc. is in every
respect, sovereign in the definition of the word
abuse.
If ZimaOffice Inc. is to cancel a subscription
without breaking the general rules that can be
done with 60 days written notice when arrears
equal to the remaining subscription period be
repaid to the customer.
2. Payment methods:
All payments are prepaid in advance by credit
card.
3. Responsibilities:
It is the customer's responsibility to the
legality of it ZimaOffice Inc. servers stored
material follows the US legislation and comply
with written and unwritten codes of ethics
around the Internet. ZimaOffice Inc. are solely
responsible for any errors or omissions in
accordance with US law for loss, except for
errors in applications, system crashes,
unauthorized access, consequential, lost profits
or other direct or indirect loss.
Notwithstanding the foregoing, ZimaOffice Inc.
responsibility at all times be limited in amount
to the customer's payment for 12 months before
the tortious acts occurred.
ZimaOffice Inc. is not responsible for any
losses caused by force majeure, including
statutory authority actions or the like, failing
power supplies, failure of telecommunications,
fire, smoke damage, explosion, water damage,
vandalism, burglary, terrorism or sabotage,
strike, lockout, boycott or blockade . This
applies even if ZimaOffice Inc. is a party to
the conflict, although conflict only affects
parts of ZimaOffice Inc. functions.
4. Backup of Data:
Backup is made several times a day and is
divided into 2 categories, respectively,
database backup and backup the physical files
and documents uploaded to the servers. For
category 1, which includes databases containing
daily data and financial data is backed up on
these every 15 minutes around the clock. For
category 2, the physical files and documents
uploaded to the servers, made backups of these
every day. Backup is made to external disk
servers initially, which then once in the day
copied to external location outside the hosting
center to secured storage.
5. Data security & accessibility
ZimaOffice Inc. store customer data 90 days
after the subscription end, then deleted from
ZimaOffice Inc. serves. After subscription
period in accordance with the above, ZimaOffice
Inc. obligation to delete and destroy all data
after the retention period.
ZimaOffice Inc. have an obligation to disclose
data is uploaded and delivered to the customer
enters the system at any time, provided the
maximum 90 days after the subscription ended.
ZimaOffice Inc. may charge the customer a fee
for this service if no other agreement is
reached. This amount can not exceed more than
general prices and the actual work performed.
Due to the lack of data access non-payment by
client side, data will only be handed out to
prepayment of expected work according to the
above, and payment of past due bills and late
fee. In bankruptcy estate's obligation to
disclose information to the customer.
6. Privacy
ZimaOffice Inc. recognizes and meets strict
confidentiality and hemligholdelse of all data
and information that customers upload to the
system. ZimaOffice Inc. can not disclose
information to third parties without prior
written consent of the owner of the data.
Disclosure of data to any authority, can only be
done by court order.
7. Development
ZimaOffice Inc. reserves the right to
continuously change and update applications in
the system. During updates may cause
disturbances and interruptions of operation of
the system, which will however attempt to
decrease the most, like major update will happen
in the period outside normal working hours.
8. Anti-Spam Policy
ZimaOffice Inc. have a no tolerance spam policy.
ZimaOffice Inc. customer support actively
monitors large import lists and emails going to
a large number of contacts. Any customer who
turns out to use ZimaOffice for / to spam will
be immediately closed down by the use of the
product and the customer is not entitled to any
compensation or refund of prepaid subscription.
Customer may, in cases of large spam will be
billed for costs which are coming to whitelist
any IP numbers and domains, due to black
listing. ZimaOffice reserves the rights to sue
the client for breach of this code and claim
compensation for lost earnings and costs of
being black-listed in various anti-spam
databases, and the time consumed in the white
listing of IPnummer again.
What is spam? Spam is unsolicited email also
known as UCE (Unsolicited Commercial Email). By
sending email to only those who have requested
to receive it, you are following accepted
permission-based email guidelines.
What is a pre-existing business relationship?
The recipient of your e-mail has made a
purchase, requested information, responded to a
questionnaire or survey, or had offline contact
with you.
What constitutes consent? The recipient of your
e-mail has been clearly and fully informed about
the collection and use of his email address and
has consented prior to such collection and use.
This is often called informed consent.
9. Price changes
ZimaOffice Inc. reserves the right to change
price according to general price developments in
the market and increases in net price index and
changes in the packages and modules.
